Terms & Conditions of Hire

Article 1: Booking and Pricing

The applied rental rate is the one in effect at the time of your booking or signature of this contract. Prices are expressed in Dirhams (MAD) or Euros (€) inclusive of all taxes. Any subsequent modification to the booking (duration, vehicle category or options) may result in a reassessment of the initial rate.

Article 2: Late Arrivals and Cancellation (Grace Period)

The customer is required to show up at the agreed time when booking. In the event of a delay exceeding 2 hours without prior notification, the booking will be considered cancelled (No-show). In this case, Ouailcar reserves the right to dispose of the vehicle and apply cancellation fees according to current terms.

Article 3: Driver Requirements

The vehicle may only be driven by the main renter or the additional drivers duly named on the rental contract. Any driver must be at least 21 years of age and have held a valid driving licence for at least 2 years.

Article 4: Documents and Guarantee (Deposit)

The renter must present the originals of their driving licence and a valid piece of ID (National ID Card or Passport). A security deposit is mandatory as a vehicle guarantee. Ouailcar accepts this deposit by credit card or in cash. This amount is intended to cover any potential damage, fuel shortages, or additional fees.

Article 5: Condition of the Vehicle and Equipment

The vehicle is delivered to the renter in good working order, clean, and with a full tank of fuel, unless otherwise specified in the contract. A joint inspection is carried out upon departure. The renter must report any unlisted anomaly before leaving the branch. Otherwise, the vehicle is deemed conforming and in perfect body and mechanical condition.

Article 6: Obligations and Usage

The renter agrees to use the vehicle cautiously and normally. It is strictly forbidden to: Transport dangerous, flammable or illegal goods; Push or tow any other vehicle; Participate in sports competitions or rallies; Drive under the influence of alcohol, drugs or medication impairing alertness; Leave Moroccan territory without official written authorisation from Ouailcar.

Article 7: Maintenance and Repairs

The renter must carry out basic maintenance on the vehicle (checking oil and water levels and tyre pressure). In the event of a breakdown or incident, the renter must notify Ouailcar immediately. No mechanical repairs may be undertaken without the prior written consent of Ouailcar.

Article 8: Returning the Vehicle

The hire ends on the date and time stipulated in the contract. A tolerance period of 2 hours is granted. Beyond this, an additional day will be charged. The vehicle must be returned in its original state of cleanliness; otherwise, a valeting fee will be charged.

Article 9: Insurance and Liabilities

Civil Liability: Included for damage caused to third parties. Excess: In the event of an at-fault claim or theft, the renter remains liable for an excess, the amount of which is set according to the vehicle category: €500 for city cars, €1000 for SUVs and €1500 for compacts (unless subscribed to the Zen package). Exclusions: Damage to tyres, rims, windscreen cover, fuel errors, and lost keys are not covered, unless a specific option is taken. Forfeiture of cover: Any reckless driving, failure to comply with the highway code, or failure to return the agreed statement of facts within 48h voids the insurance coverage.

Article 10: Fuel and AdBlue

The vehicle must be returned with the same fuel level as upon departure. If the level is lower, the renter must pay for the missing fuel at the current rate, plus a refuelling service fee. Any fuel error (filling with diesel instead of petrol or vice versa) results in the renter's total liability for repair and towing costs, even under the Zen package.

Article 11: Fines and Traffic Violations

The renter is solely responsible for fines, traffic tickets, and reports issued against them during the rental period (speed cameras, parking, etc.). Ouailcar will forward the renter's details to the relevant authorities upon request. A 200 MAD admin fee will be charged by Ouailcar for each processed fine.

Article 12: Rental Extension

Any extension of the rental period must be agreed upon in advance with Ouailcar at least 24 hours before the expiry of the current contract. The renter must visit the branch to sign an addendum or a new contract and settle the payment. Failing an agreement, Ouailcar reserves the right to repossess the vehicle wherever it may be, at the renter's expense.

Article 13: Theft of Personal Belongings

Ouailcar declines all liability in the event of loss, theft, or damage to objects and personal belongings left or forgotten inside the vehicle during or after the rental period.

Article 14: Vehicle Immobilisation

In the event of an at-fault accident or misuse resulting in the prolonged immobilisation of the vehicle for repairs, Ouailcar reserves the right to charge the renter an immobilisation fee based on the daily rate of the rented vehicle category.

DESCRIPTION OF OUAILCAR SERVICE PACKAGES

Pack BASIC

BASIC Package: This package includes mileage limited to 200 km per day. It includes standard insurance (Theft and Collision Damage Waiver) subject to the full application of the excess (€500 for city cars, €1000 for SUVs, €1500 for compacts). Additional driver and baby seat options are not included.

Pack ESSENTIEL

ESSENTIAL Package: This package offers unlimited mileage and advanced insurance also covering the windscreen and tyres. The excess is reduced (€300 for city cars, €500 for SUVs, €800 for compacts). This package includes an additional driver, a baby seat, and 24/7 breakdown cover for free.

Pack ZEN

ZEN Package: This is maximum protection with unlimited mileage and 'Fully Comprehensive' insurance with €0 Excess. The renter is totally exempt from financial liability in the event of covered damage. This package also includes the additional driver, baby seat, and 24/7 breakdown cover.
